The Legislature remains in recess, most likely until after the November elections. NJSA is actively advocating and reviewing a number of legislative proposals. Some key issues include:
A3372- This legislation requires prevailing wage to be paid on projects receiving any type of financial assistance or incentive from the Board of Public Utilities. The bill has been signed by Governor Corzine and is now law.
A3569- The bill provides for the Department of Labor to enforce Stop Work Orders on contractors alleged to have violated workers compensation laws. The bill was amended at the request of NJSA to provide that only the specific contractor alleged to be in violation would be covered by the Stop Work Order, rather than the entire project, as the bill was originally drafted. This legislation has also been signed and is now law.
A3317- Requires individuals performing electrical work on public facilities to be properly qualified. The legislation has passed both houses of the legislature and is under review by the Governor’s Counsel’s office.
A1009- Requires advance approval from the state prior to subcontractor changes in certain cases. The bill has passed the full Assembly and has been referred to the Senate State Government Committee.
A3698- Requires contracting entity to specify the basis and criteria for determining lowest responsible bidder when utilizing alternates. The bill has also passed the full Assembly and is available for review by the Senate State Government Committee.
NJSA staff is actively monitoring more than 170 specific pieces of legislation including the above bills. A full list of bills under review is attached.
